This is a petition for grant of anticipatory bail for offence under Sections 376 and 506 of the Indian Penal Code.

Allegation is that the petitioner pretended that he would marry with the informant and established physical relation.

Submission of the petitioner is that the matter is of consensual sex since 2011. After the relation between the two got strained, false case has been lodged. No case under Section 376 of the Indian Penal Code is made out.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be

Patna High Court Cr.Misc. No.12953 of 2017 (2) dt.24-03-2017 2/2 released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Jamui Mahila P.S. Case No. 38 of 2015 to the satisfaction of the Subdivisional Judicial Magistrate, Jamui, or successor Court, subject to the conditions laid down under Section 438(2) of the Criminal Procedure Code and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
