JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-11-2018 Petitioner prays for bail in connection with C.R.No. 1499 of 2015, corresponding to T.R.No. 1327 of 2018 lodged for the offences punishable under Sections 498A, 323, 504 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
Allegation against the petitioner is of committing torture and cruelty to his wife and it further appears that earlier also he was made accused in similar type of case in which he was granted bail on compromise for depositing of Rs.1,45,000/- in the name of complainant but he had not deposited the same. Submission of learned counsel for the petitioner is that he is ready to transfer the aforesaid amount if provisional
Patna High Court Cr.Misc. No.67980 of 2018(2) dt.30-11-2018 2/2 bail is granted to him and petitioner is in custody since 13.9.2018.
Heard learned APP and learned counsel for the informant.
Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to learned court below to release the petitioner on provisional bail for 15 days so that he may transfer Rs.1,45,000/- in the account of the complainant and once he has transfer the amount and submitted document in support thereof, his provisional bail bond shall be confirmed, otherwise his bail bond shall be cancelled.
