Smt Pushpa Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-11-2018 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Bangaon P.S. Case No. 48 of 2017 instituted for the offence under Section(s) 302, 120(B), 201 of the Indian Penal Code. Learned counsel for the petitioner is permitted to make necessary correction in the bail petition. In the written report it is alleged that Arjun Khan along with Bhusan Khan had taken the father of the informant to load bamboo on the tractor. It is further alleged that when the informant raised objection then both of them told that business man Ranjit Yadav had also come to purchase the bamboo and thereafter the father of the informant went with them. Later on, the informant got information that dead body of his father was

Patna High Court Cr.Misc. No.68118 of 2018(2) dt.26-11-2018 2/2 lying in the premises of Bangaon police station. Learned counsel for the petitioner has submitted that co accused Arjun Khan has already been granted bail by coordinate Bench of this Court by order dated 19.2.2018 passed in Cr. Misc. no. 62798 of 2017.

From the written report itself, it appears that there is no allegation of specific over act against this petitioner. Petitioner is in custody since 27.7.2018 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Saharsa in connection with Bangaon P.S. Case No. 48 of 2017, subject to the condition that both the bailers shall be the close relative of the petitioner.
