JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 10-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the opposite party no.2 The petitioner apprehends his arrest in connection with Complaint Case No.2732 of 2014 registered under Section 498-A of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act. Learned counsel for the petitioner and the learned counsel for the opposite party no.2 submit that earlier, on their joint prayer, the matter was referred by this Court to the Patna High Court Mediation Centre, Patna, for settlement of the dispute in between the petitioner and the opposite party no.2, who are husband and wife respectively, where both settled their dispute in terms of the memorandum of

Patna High Court Cr.Misc. No.16220 of 2017 (5) dt.10-10-2017 2/2 agreement dated 18.09.2017. The memorandum of agreement in between the petitioner and the opposite party no.2 is part of the report of the Mediator, Patna High Court Mediation Centre, Patna, dated 21.09.2017. According to the aforesaid memorandum of agreement dated 18.09.2017, the opposite party no.2 decided to live separate and Rs.6,00,000/- has already been paid by the petitioner to the opposite party no.2. Now, the opposite party no.2 has no grievance against the petitioner.

Since the petitioner and the opposite party no.2 have settled their dispute before the Patna High Court Mediation Centre, Patna, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, East Muzaffazrpur, in connection with C.A. Case No.2732 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C.
