2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Hussainganj P.S. Case No. 3 of 2024 registered for the offence punishable under Sections 392 and 302 of the Indian Penal Code and under Section 27 of the Arms Act.
3. Earlier the bail application of the petitioner has been rejected vide order dated 06.03.2025 passed in Cr. Misc. No. 10318 of 2025, which reads as under:
"Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.
2. The petitioner seeks bail in connection with Hussainganj P.S. Case No. 3 of 2024 registered for the offence under Sections 392 and 302 of the Indian Penal Code and under Section 27 of the Arms Act.
3. As per the prosecution case, while
Patna High Court CR. MISC. No.71302 of 2025(3) dt.09-02-2026 2/2 committing loot, unknown criminals have killed the deceased.
4. The motorcycle used in the killing of the deceased has been recovered from the house of the petitioner who has participated in the crime.
5. The petitioner is in custody since 19.02.2024.
6. Considering the serious allegations of loot and murder against the petitioner, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this application is dismissed. 8. The Court below is directed to expedite the trial of the petitioner and conclude the same at the earliest."
4. Considering the gravity of offence, I am not inclined to grant bail to the petitioner.
5. Accordingly, the application stands dismissed.
6. The Court below is directed to expedite the trial.
7. The Superintendent of Police, Siwan is directed to ensure the appearance of the witnesses in the trial so that the trial is not delayed.
8. Let a copy of this order be communicated to the Principal District Judge, Siwan and the Superintendent of Police, Siwan forthwith through FAX or e-mail for its compliance.
