JUSTICE BIRENDRA KUMAR ORAL ORDER 15-05-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.

The FIR of abduction and murder is against unknown.

Name of the petitioner had transpired in the confessional statement of the co-accused Ram Pravesh Kumar. On the basis of statement of Ram Pravesh Kumar, the dead body was recovered. However, Ram Pravesh Kumar has not alleged anything specific against the petitioner in his confessional

Patna High Court Cr.Misc. No.15618 of 2017 (4) dt.15-05-2017 2/2 statement as submitted by learned counsel for the petitioner. Learned counsel for the State concedes that there is no other material than statement of the co-accused before the police against the petitioner.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna/successor Court in connection with Gopalpur Police Station Case No. 06 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
