The petitioner apprehends his arrest in connection with Complaint Case No. 769 of 2019 registered under Sections 354B, 323, 506, 456 and 448 of the Indian Penal Code. The accusation is that at about 11 A.M. on 30.05.2019, while the family members of the complainant Amola Devi were sleeping at the roof of the house but she was in the room and the door of the room was closed slightly in the summer session. At that time the petitioner in drunken state entered into the room of the complainant and on the point of knife, he tried to commit rape upon the complainant but anyhow she raised alarm and then the family members woke up and got down from the roof. Patna High Court CR. MISC. No.66584 of 2019(2) dt.07-11-2019 2/2 was being chased, he succeeded to flee away but thereafter Dinesh Das and Pappu Das tried to outrage the modesty of Sharda Devi. Submission is that Sono P.S. Case No. 127 of 2019 was instituted on 10.05.2019 by the brother of the petitioner against the informant of the present case and other family members under Sections 147, 341, 323, 354B, 379, 504 and 506 of the Indian penal Code and due to that reason, the present complaint has been filed. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Mr. Maneesh Kumar, learned Judicial Magistrate 1st Class, Jamui in connection with Complaint Case No. 769 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
