2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 317(5) of the BNS and under Section 30(a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that from a Mahindra pick-up which was being driven by this petitioner altogether 1120.35 liters of country made foreign liquor was recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. Learned counsel has further submitted that petitioner is only the driver and he was not having any knowledge regarding the illicit

Learned counsel has lastly submitted that the petitioner is a man of clean antecedent and is languishing in judicial custody since 28.07.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Benibad P.S. Case No. 120 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise, court no.-III, Muzaffarpur.
