JUSTICE SANJAY PRIYA ORAL ORDER 2/ 31-10-2018 This application has been filed for modification of the order dated 11.04.2018 passed in Cr. Misc. No.4941 of 2018 by which petitioner has been granted provisional anticipatory bail in connection with Khagaria (Chitragupt Naga) P.S. Case No.558 of 2017 to the satisfaction of Chief Judicial Magistrate, Khagaria, with certain conditions.

Counsel for the petitioner submits that in compliance of the aforesaid order he has deposited Rs.1,25,000/-. He could not deposit remaining amount due to bad financial condition. It is further submitted that he will make payment of the rest amount i.e. Rs.1,75,000/- in three equal monthly installments. In view of such, order dated 11.04.2018 passed in Cr. Misc. No.4941 of 2018 is modified to the extent that from

Patna High Court Cr.Misc. No.65283 of 2018 (2) dt.31-10-2018 2/2 now the petitioner will pay the remaining amount i.e. Rs.1,75,000/-in three installments within three months from the date of receipt of copy of this order in the Court below. It is made clear that in the event petitioner defaults in making payment of single installment, his bail bond will liable to be cancelled.

This Modification Application is, accordingly, allowed.
