JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-11-2018 The petitioner seeks regular bail in connection with Barhat P.S. Case No. 5/2018, registered for offences punishable under Sections 395 and 397 of the Indian Penal Code. Allegation as per F.I.R. is that some miscreants committed loot of ornaments worth Rs. 15,000 and mobile in the house of the informant.

It has been submitted on behalf of the petitioner that he has been made accused in this case only on the basis of confession of co-accused and it is also alleged that he made confession in other case that he is accused in the present case. However, nothing has been recovered from the petitioner and uptil no Test Identification Parade has been held. Further he has been in judicial custody since 28.05.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Jamui, in connection with Barhat P.S. Case No. 5/2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
