The petitioner apprehends his arrest in Khagaria (Gangour) P. S. Case No. 802 of 2015 registered for the offences under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
Prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 19.10.2016 passed in Cr. Misc. No. 31642 of 2016.
Learned counsel for the petitioner submits that the petitioner again filed this anticipatory bail petition on the ground that the petitioner has got land dispute that is why he has been falsely implicated in the case. It appears that the entire facts were considered, thereafter, prayer for anticipatory bail of the petitioner
Patna High Court Cr.Misc. No.18316 of 2017 (2) dt.03-05-2017 2/2 was rejected. I do not find any new ground to reconsider the prayer for anticipatory bail of the petitioner, as there is allegation that the petitioner also made firing in which the husband of the informant died.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petition is dismissed.
