Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 365 of the Indian Penal Code. Father-in-law of the informant had gone to attend Court case. However, he did not reach the Court nor return back to house. Hence, the petitioner and others have suspected to have abducted him.

Patna High Court Cr.Misc. No.16288 of 2017 (4) dt.15-05-2017 2/2 would reveal that there is no eyewitness of the occurrence supporting allegation against the petitioner; rather during investigation it has come that prosecution side has hidden the victim just to put wrongful pressure on the petitioner. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura/Successor Court, in connection with Sinheshwar P.S. Case No.74 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
