This is an application for grant of anticipatory bail in connection with Bhagwanpur P.S. Case No.150 of 2022, registered for offences under Sections 341, 323, 307, 504, 506, 379/34 of the Indian Penal Code.
The case of the prosecution, in brief, is that the petitioners no.3 and 4 had collided their

No. 69965 of 2022(2) dt.16-05-2023 2/3 motorcycle with the son of the informant, resulting in him sustaining injury whereafter, the accused persons, armed with sticks, lathi and pistol had arrived at the door of the house of the informant and had surrounded him as also his family members. The petitioner no.4 and the petitioner no.3 had then abused the informant and had ordered to kill him, whereafter all the petitioners had assaulted the informant and his family members with sticks and rod. The petitioner no.1 had assaulted the son of the informant on his head with iron rod resulting in him sustaining injuries, whereas the petitioner no.2 and other petitioners are alleged to have assaulted one Kailash Roy repeatedly, causing serious injuries on his person and then the petitioners no. 3 and 4 had assaulted Pappu Roy with butt of pistol causing injury on his person.
Having regard to the facts and circumstances of the case and taking into account the materials available on record, this Court finds that specific allegations have been levelled qua the
Patna High Court CR. MISC. No. 69965 of 2022(2) dt.16-05-2023 3/3 petitioners herein of assaulting the informant and others, resulting in them sustaining injuries, which also stands corroborated from the injury report, details whereof has been mentioned in the impugned order dated 23.09.2022, hence, I do not find the present case to be a fit case for grant of anticipatory bail, thus, the present petition stands dismissed.
