JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 74 of 2013, registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code. The accusation of informant is that he purchased 29 decimals of land but on 16.07.2012 Jagdish Prasad Poddar got executed a power of attorney from Arun Oraon with regard to entire lands including the land of the complainant, in which, petitioner and others put their signature as a witness. Thereafter, Arun Oraon sold some portion of land in favour of Ram Pukar Rai

Patna High Court Cr.Misc. No.15466 of 2017 (3) dt.10-07-2017 and Ram Pukar Rai sold a piece of land in favor of Raj Kumar Chaudhary.

Learned counsel for the petitioner submits that petitioner is simply witness on the power of attorney, which was executed by Jagdish Prasad Poddar in favour of Arun Oraon except that there is nothing against him showing involvement in the present case. Further submission is that petitioner has no criminal Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Complaint Case No. 74 of 2013, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
