2. This application, for grant of anticipatory bail, arises out of Madhuban Police Station Case No. 141 of 2025, disclosing offences punishable under Sections 480, 238, 61(2) and 3(5) of B.N.S., 2023.

3. As per the first information report, the marriage of the informant's daughter, namely Suman Kumari, was solemnized with the petitioner about two years back. After the marriage, the petitioner along with his family members started demanding Rs. 5,00,000/- and a motorcycle as dowry. Due to non-fulfillment of the demand, the accused persons, including the petitioner, started physical torture of the informant's

On 01.05.2025, in the evening, the informant got the information that his daughter Suman Kumari has been killed in her matrimonial home by petitioner and others and the dead body has been concealed. When the informant arrived at the matrimonial home of his daughter, he found the house locked and all the family members had fled.

4. Mr. Verma, learned counsel for the petitioner, argued that the informant's daughter has died her natural death and the dead body was cremated in presence of the informant and other family members. Subsequently, due to some confusion and at the behest of others, the present F.I.R. has been lodged. A compromise petition has been filed by the side of the informant before the learned concerned Court which has been annexed as Annexure-2 to this application.

5. I have heard the parties and I have gone through the materials on record. The allegation in the F.I.R. is that within two years of the marriage the informant's daughter has met with an unnatural death in her matrimonial home. Under Sections117 and 118 of the Bharatiya Sakshya Adhiniyam, 2023, there is a presumption against the accused persons. The allegation is of demand of dowry and torture. The dead body has been cremated in tearing haste.

6. Considering the aforesaid and the nature of allegation as also the fact that the petitioner is the husband of the deceased, I am not inclined to grant anticipatory bail to the petitioner.
