The petitioner is apprehending his arrest in connection with Nath Nagar (Lalmatia) P.S. Case No. 648 of 2018 for the offence registered under Sections 314, 323, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that though the allegations are under Section 341, 323, 504 and 506 of the Indian penal Code, the same are bailable and so far as the allegation under Section 27 of the Arms Act are concerned, the alleged recoveries were not from his conscious possession. It is further submitted that there is case and counter case between the parties and for the said reasons, the petitioner has falsely been

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 1st Bhagalpur in connection with Nathnagar (Lalmatia) P.S. Case No. 648 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
