====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Excise Case No. 122 of 2017 arising out of Korma P.S. Case No. 89 of 2014 instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 47(A) of Excise Act.
Counsel for the petitioner submits that this case has been lodged under old Excise Act. Counsel for the petitioner further submits that Police got information that two persons are manufacturing illicit liquor, they proceeded to the place of occurrence. The accused persons managed to run away on seeing the police party. Thereafter, the police demolished the Chulha and other articles and seized 150 liters illicit Mahua liquor. As such, the petitioner was not arrested on spot. There is

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, Sheikhpura, in connection with Excise Case No. 122 of 2017 arising out of Korma P.S. Case No. 89 of 2014, subject to the condition that both the bailors will be the close relatives of the petitioner.
