JUSTICE SHIVAJI PANDEY ORAL ORDER 17-01-2018 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the opposite party no.2.

In this case, a prayer has been made for cancellation of bail of the opposite party no.2, which has been granted by this Court in Criminal Miscellaneous No.45470 of 2013 vide order dated 29.01.2014 in connection with Rupaspur P.S. Case No.72 of 2012 for the offence under Sections 376, 420 and 384/34 of the Indian Penal Code.

This Court had called for the report from the Officer-in-Charge of the Rupaspur Police Station. The Station

Patna High Court Cr.Misc. No.15707 of 2017 (4) dt.17-01-2018 2/2 House Officer, Rupaspur Police Station, Patna, has submitted the report, in which it has been stated that Malti Devi, is residing in her house peacefully and Malti Devi has completed the deposition on 13.10.2017 before the A.D.J-XI, in Sessions Trial No.1351 of 2013.

This Court directs the Station House Officer, Rupaspur Police Station, Patna that he will ensure that Malti Devi, be not disturbed in any manner and she should be allowed to remain in her house peacefully subject to the order passed by the competent Court. This Court also directs the Presiding Officer to conclude the trial without unnecessary delay. With the aforesaid observations and directions, this application is disposed of.
