This application is for grant of regular bail in connection with Barachatty P.S.case No.322 of 2016, G.R.No.1367 of 2016, for the offences under Sections 20, 22 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985.
Allegation against the petitioner is about recovery of 75 kg. 'Ganja' from his Vehicle and he has been arrested at the spot. It is submitted on behalf of the petitioner that the petitioner is owner of the vehicle and he has nothing to do with the seized 'Ganja' as he has no knowledge about Ganja kept in his vehicle and it is also argued that the petitioner is in custody since 20.8.2016. He has no criminal antecedent.
Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.19514 of 2017 (2) dt.03-05-2017 2/2 bail.
Having heard both sides and in view of recovery of huge quantity of 'Ganja', I am not inclined to grant bail to the petitioner, however, the as the petitioner is in custody for about nine months, the learned trial court is directed to expedite the trial of the petitioner.
With the aforesaid observation, this application is dismissed.
