The petitioner seeks regular bail in connection with Pauthu P.S. Case No. 58 of 2018 for the offenses punishable under Sections 366(A)/34 of the Indian Penal Code. The allegation according to the informant is that her daughter was kidnapped by the accused persons including the petitioner for the purposes of getting her married. The learned counsel for the petitioner submits that the statement of the victim girl recorded under Section 164 Cr.P.C. would bear it out that she had voluntarily travelled with the co-accused, namely, Subodh Yadav and thereafter solemnized marriage with him. It is further submitted that as far as the petitioner is concerned, admittedly he had no role to play

Patna High Court Cr.Misc. No.70460 of 2018(2) dt.12-12-2018 2/2 in the alleged kidnapping of the victim girl. It is further submitted that the victim girl and the co-accused Subodh Yadav are living happily after being married and have also filed a compromise petition before the learned trial court which has resulted in grant of bail to the said Subodh Yadav by the learned trial court itself by an order dated 04.10.2018 passed in Bail Petition No. 953 of 2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Pauthu P.S. Case No. 58 of 2018.
