In this case, the petitioners are seeking anticipatory bail in connection with Bakhtiyarpur P.S. Case No.525 of 2017, registered for the offence under Sections 147, 148, 149, 307 and 337 of the Indian Penal Code and under Section 27 of the Arms Act.

Allegation has been made that accused persons including these petitioners came to the house of the informant and started abusing and assaulting him by saying that he is the person at whose instance the liquor has been seized. It has also been alleged that they have resorted to firing upon the informant. One empty cartridge was recovered by the Police.

Patna High Court CR. MISC. No.68379 of 2019(3) dt.06-03-2020 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
