JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This application, for grant of anticipatory bail, arises out of Gopalganj P.S. Case No. 190 of 2019, disclosing offences under Sections 341, 342, 323, 324, 307, 379, 354, 504 and 34 of the Indian Penal Code.
Allegation against the petitioner is of stabbing the informant and of trying to pull her sari.
Submission of learned counsel for the petitioner is that there is case and counter case between the parties and as per his instruction, the injury sustained by the informant was found simple in nature.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with
Patna High Court CR. MISC. No.70108 of 2019(2) dt.15-11-2019 2/2 direction to the petitioner to surrender in the court below within a period of three weeks from the date of receipt of ac copy of this order, on which, the court below shall release the petitioner on provisional bail and in the meantime, call for injury report to verify the nature of injury caused to informant and if the submission of learned counsel for the petitioner that injury sustained by the informant is simple in nature, he will confirm the provisional bail of the petitioner otherwise, he is free to pass any order as he deems fit and proper including cancellation of provisional bail of the petitioner.
