JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 419, 420, 465, 467, 468 of the Indian Penal Code.
The complaint petition goes to show that it were coaccused Hari Shankar, Kalawati Devi and Munna Singh, who got executed sale deed impersonating the complainant and it was co-accused Umashankar Singh, who stood witness on the aforesaid sale deed. So far as petitioner is concerned, though he is named in the complaint petition but no overt act has been attributed against him. Moreover, co-accused Hari Shankar
Patna High Court Cr.Misc. No.64523 of 2018(2) dt.12-12-2018 2/2 Singht and Kalawati Devi have already been admitted to anticipatory bail vide order dated 30.01.2014 passed in Cr. Misc. No. 28084 of 2013.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Bhojpur, Ara in Complaint Case no. 1543(c) oF 2011,subject to condition as laid down under Section 438(2) of the Cr.P.C.
