The petitioner apprehends his arrest in connection with Pusa P. S. Case No. 100 of 2016 for the offences punishable under Sections 341, 387, 504 and 506 of the Indian penal Code. The allegation of informant, Kamod Narayan Jha, Headmaster of Rajkiya Buniyadi Vidyalaya Nauachak is that on 30.09.2016 when he reached near school, then this petitioner stopped his motorcycle and asked to give commission in mid day meal then he made protest that the money of mid day meal is related to students but the petitioner threatened him of dire consequences.
Patna High Court Cr.Misc. No.17793 of 2017 (3) dt.11-08-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that in fact the petitioner is one of the members of Shiksha Samittee Rajkiya Buniyadi School, Nawachak and due to irregularity committed by the informant he asked to furnish the details but he refused. Thereafter, he filed an application under Right to Information Act, 2005 for information but information was not furnished and at present Second Appeal, numbered as 126531/14-15 is pending. As such due to give undue pressure upon the petitioner, informant has lodged the present case. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within four weeks from today, be enlarged on bail on furnishing bail bond of Rs.
10,000/- (Rupees Ten thousand)with two sureties of the like amount each to the satisfaction of Shri Shankesh Chandra, learned Additional Chief Judicial Magistrate- VI, Samastipur in connection with pusa P.S.Case No. 100 of 2016, subject to the conditions laid down under Section 438 (2) Cr. P. C.
