2. The petitioner is apprehending his arrest in connection with Narayanpur P.S.Case No.61 of 2023, FIR dated 17.06.2023 registered for the offences punishable under Sections 456,379 and 511 of IPC.

3. Allegation against the petitioner is that he entered into the house of the informant and tried to commit theft.

4. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed

5. Learned A.P.P. for the State, on other other hand, on the basis of the material available on the record, has vehemently opposed the prayer for anticipatory bail of the petitioner and submits that the mobile phone of the petitioner was recovered from the place of occurrence.

6. Considering the aforesaid fact and mobile phone of the petitioner was recovered from the place of occurrence, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Narayanpur P.S.Case No.61 of 2023 pending in the court of learned C.J.M., Bhojpur at Ara.

7. Prayer is refused.
