====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 06-05-2025 The petitioner appears along with his counsel and learned counsel for the informant is appearing along with the brother of the informant in the Chambers proceedings.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 494, 313, 377, 504, 506/34 of the Indian Penal Code.
3. Petitioner, who is husband of informant, is said to have tortured upon her physically and mentally in association of his family members over the dowry demand.
4. Learned counsel for the petitioner denies all the allegations levelled in the FIR and rather states that the informant is suffering from some genetic problem due to which
Patna High Court CR. MISC. No.73496 of 2024(6) dt.06-05-2025 2/3 she cannot attend to her daily course and this fact was concealed by the family of the informant at the time of marriage. Some bank statement of the petitioner has also been brought on record by way of Annexure-P/2 showing that the petitioner has been transferring money to the informant's brother for meeting the expenses of his wife. Further, it is also submitted that there is a daughter out of the wedlock, who is staying alongwith the petitioner and he is taking care of her education as well.
5. Learned counsel appearing for the informant opposes the prayer for bail anticipatory bail and supports the allegations made in the FIR.
6. At this stage, the petitioner, who is present in person, makes an offer to pay an amount of Rs. 10,000.00/- (Rupees Ten Thousand) per month to the informant in the second week of every month to which learned counsel for the informant agrees.
7. Considering the above mentioned facts and circumstances, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor

(2) of the Cr.P.C.
8. It goes without saying that the aforesaid payment shall be subject to any order being passed in matrimonial maintenance case or any other collateral proceedings.
9. Learned counsel for the informant is directed to furnish the bank account details of the informant in the learned Court below. If the informant fails to furnish the same, the aforesaid amount will be deposited in the learned Court below which will be released in favour of the informant after she furnishes her bank account details. If the petitioner fails to pay the aforesaid amount on two consecutive months, the informant shall be at liberty to move before the learned Court below for cancelling the bail bond of the petitioner.
