The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 506, 504/34 of the Indian Penal Code.
Allegation is that the accused persons including the petitioner assaulted the informant by means of lathi and iron rod, due to which he sustained injuries. Co-accused Laddu Sah attacked the father of the informant with farsa causing injury on left side of his head and he fell down on the ground. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.08.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. No specific injury is
Patna High Court CR. MISC. No.63826 of 2019(2) dt.21-10-2019 2/2 attributed against the petitioner. Specific allegation of assault is against co-accused Laddu Sah, who assaulted the father of the informant.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Paharpur P.S. case No.160 of 2019.
