JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with S. Tr. No. 425 of 2016 new S. Trial No. 481 of 2016 arising out of Bheldi P.S. Case No. 16 of 2010, registered under Section 436/34 of the Indian Penal Code and 17 of the C.L.A. Act.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, the petitioner was apprehended by the police, who got recorded the confessional statement of the petitioner, except that there is nothing against the petitioner showing his involvement in the present case. It is further submitted that while petitioner is accused in four other cases, but in all four cases, he is on bail and

Patna High Court Cr.Misc. No.17563 of 2017 (2) dt.27-04-2017 in the present case, he is in custody since 21.01.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 9th Additional Sessions Judge, Saran at Chapra, in connection with S. Tr. No. 425 of 2016 new S. Trial No. 481 of 2016 arising out of Bheldi P.S. Case No. 16 of 2010. Out of two sureties, one surety must be the close relative of the petitioner.
