In this case, the petitioner is seeking regular bail in connection with Hussainganj P.S. Case No. 139 of 2022, registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506/34 of the IPC and 27 of the Arms Act. As per allegation, the petitioner fired shot and made injured to the informant, who sustained injuries in his thigh. The learned counsel for the petitioner has submitted that there is there is case and counter case. He has submitted further that sister-in-law(bhabhi) of the petitioner has lodged two cases against the prosecution side. In counter case, the members of defense side have also sustained injuries. The petitioner is a person of clean antecedent and he is under

Patna High Court CR. MISC. No.68647 of 2022(2) dt.15-03-2023 2/2 custody since 10.10.2022.

On the other hand, the learned counsel for the informant has opposed the prayer for bail.

Considering above-mentioned facts and circumstance as well as the clean antecedent and the period of incarceration, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IX, Siwan in connection with Hussainganj P.S. Case No. 139 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
