The petitioner seeks regular bail in connection with Itarhi PS case no. 145 of 2019 instituted for the offence punishable under Sections 399, 402 of Indian Penal Code and Sections 25(1-B)a, 26, 35 of Arms Act.

The allegation is regarding recovery of one loaded pistol from the petitioner herein after he was apprehended by the police and search was made. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, is having a clean antecedent and is languishing in custody since 14.06.2019.

Having regard to the facts and circumstances of the

No.69751 of 2019(2) dt.10-01-2020 2/2 case, considering the submissions made by the learned counsel for the petitioner and taking into account the period of incarceration of the petitioner, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Buxar in connection with Itarhi PS case no. 145 of 2019.
