2. The petitioner is apprehending his arrest in connection with Mehandiganj P.S. Case No. 168 of 2020, lodged on 03.11.2020, under Sections 363, 366A/34 of the Indian Penal Code.

3. As per the FIR, there were three named accused persons including the present petitioner against whom there is an allegation of kidnapping.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the antecedent of the petitioner is clean. Counsel further submits that the said FIR has been lodged under wrong impression but the situation is otherwise. Counsel further submits that recovery of the victim has already been taken place

Patna High Court CR. MISC. No.75624 of 2024(2) dt.11-11-2024 2/2 and in her statement under Section 164 of the Cr.P.C., she has admitted that marriage was solemnized between the petitioner and the said victim which is acceptable to all the family members.

5. Learned APP for the State opposes the prayer for bail.

6. Learned Counsel for the informant, namely, Mr. Shashikant Kumar, submits that the said marriage was solemnized between the petitioner and the informant which is acceptable to both the family members and they are living a happy and peaceful life.

7. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Patna City in connection with Mehandiganj P.S. Case No. 168 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Aman Kumar/- (Dr. Anshuman, J) U T
