The Petitioner seeks bail in Pakaridayal P.S. Case No. 120 of 2016 instituted for the offence under Section(s) 25(1-B) a, 26, 35 of the Arms Act.

It has been submitted on behalf of the petitioner that there is no recovery of any incriminating article from the possession of this petitioner. The name of the petitioner has been disclosed in the written report itself by co-accused Abhishek Singh.

Learned A.P.P. has stated that petitioner has criminal antecedent.

It has further been submitted that similarly situated co-accused Suman Kumar Singh has already been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 15890 of 2017.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Pakaridayal P.S. Case No. 120 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
