The petitioner seeks bail in connection with Hussainganj P.S. Case No.247 of 2019 registered under Sections 272, 273 and 420/34 of the Indian Penal Code besides Sections 30(a), 38(II) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving the secret information about carrying the liquor loading on the Bolero Pickup van for concealing in the house of Sandeep Chaudhary in village-Fazilpur, the informant alongwith other police personnel reached there. On search of the house of Sandeep Chaudhary, a Bolero pickup van was found parked from which 98 cartoons, each containing of 48 bottles of 180 ml. Indian Made Foreign Liquor, were recovered. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the alleged recovery is said to be made from the Bolero Pickup van parked in the house of Sandeep Chaudhary and this petitioner was apprehended at the door of Sandeep Chaudhary in suspicious condition. The petitioner has no criminal antecedent and is in custody since 01.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan, in connection with Hussainganj P.S. Case No.247 of 2019.
