====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-02-2024 Heard learned counsels for the petitioner and Mr. Rabindra Kumar, learned A.P.P. for the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 366 of Indian Penal Code.
3. It is alleged this petitioner kidnapped the wife of the informant.
4. Learned counsel appearing for the petitioner submits that victim in her statement, recorded under Section 164 of Cr.P.C., has denied the prosecution case and has categorically stated that due to ill-treatment of her husband i.e. the informant, she got upset and left the house with the petitioner on 5.07.2013.
5. Considering the statement of the victim recorded
Patna High Court CR. MISC. No.72443 of 2023(3) dt.29-02-2024 2/2 under Section 164 of Cr.P.C., this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P. S. Case No. 849 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
