JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2017 The petitioner is apprehending his arrest in connection with Sheikhpura P.S. Case No. 12 of 2017, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, and 353 Indian Penal Code and Section 27/30 of Arms Act. Petitioner is named in the F.I.R and allegation against the petitioner is of firing.

It has been submitted on behalf of the petitioner that though there is allegation of firing against the petitioner, however, nobody has received any injury from the said firing. Petitioner has clean antecedent and nothing has been recovered from the petitioner.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.18006 of 2017 (2) dt.02-05-2017 2/2 circumstances of the case and the nature of allegation, I am not inclined to grant the petitioner privilege of bail, his application for anticipatory bail is, accordingly, rejected.

Let petitioner surrender before the court below and pray for regular bail and if any such application is filed, the court below after considering the submission of learned counsel for the petitioner, shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court. With the above observation, this application is disposed of.
