Petitioner seeks bail in Sahebpur Kamal P.S.Case No.255 of 2018 registered under Section 414 of I.P.C. Allegation against the petitioner is that in course of checking of the vehicle the police intercepted the Bolero vehicle which was driven by the petitioner and on query he could not produce any paper of the vehicle as the said vehicle was of stolen one.

Submission on behalf of the petitioner is that the petitioner has been falsely implicated at the instance of the vehicle owner and he is in custody since 11.08.2018 having no criminal antecedent.

Heard the learned A.P.P. also.

Patna High Court Cr.Misc. No.67981 of 2018(2) dt.29-11-2018 2/2 Having heard both sides and in view of the facts and circumstances of the case, as stated above, at this stage I am not inclined to grant bail to the petitioner.

However, this application is disposed of with direction that once charge is framed against the petitioner or he completes six months in custody, the learned court below shall release the petitioner on bail to his own satisfaction on undertaking that he will cooperate in the trial. With the aforesaid, this application is disposed of. (Vinod Kumar Sinha, J) aks/- U
