1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Bahadurpur P.S. Case no. 276 of 2022 registered under sections 30(a), 32(2)(3), 36 and 41(1)(2) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, 20 litres of country liquor was recovered from one Karan Kumar and he was taken into custody. It is further stated that on inquiry, he disclosed that the liquor had been sent by his three friends including the petitioner herein who were involved in the business of liquor.
4. Learned counsel for the petitioner submits that neither any incriminating article was recovered from the petitioner's possession nor was he arrested at the spot. The only
Patna High Court CR. MISC. No.71220 of 2025(2) dt.15-10-2025 2/2 material against him is the statement of co-accused made before police. The petitioner has no criminal antecedent and undertakes to cooperate in the investigation/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., even as per the allegations no incriminating article having been recovered from the petitioner's possession, the only material being the statement of a co-accused made before police and the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bahadurpur P.S. Case no. 276 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court of Excise, Patna City, Patna.
