The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 504, 506, 354 and 379/34 of the Indian Penal Code. The prosecution case as per the written report of informant Chandan Kumar submitted to the Station House Officer of Gaya Police Station is to the effect that 17.08.2018 at around 8.00 P.M., all the accused persons including the petitioner came, variously armed and entered into the house of the informant by breaking open the door and started assaulting the informant. When the wife of the informant came to rescue, then this petitioner assaulted her with fists and slaps, snatched a gold chain and undressed her. It is submitted by learned counsel for the petitioner that no injury was caused to anyone and for a petty dispute, the accusation has been levelled against the petitioner and others. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner is named in the First Information Report with specific accusation. Considering the nature of accusation coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Gaya Kotwali P.S. Case No. 398 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
