The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 341, 323, 337, 338, 307, 332, 353, 153, 153(A), 153(B), 295, 298, 379, 427, 504, 120(B) of the Indian Penal Code.
The prosecution case, in brief, is that having received the information regarding apprehension of disturbing law and order situation, the informant reached at the place of occurrence. He found that a mob consisting of some local leaders, nearby people and members of Bajrang Dal were raising objectionable slogan and creating unruling scene. In spite of attempt made by administration, the mob
Patna High Court Cr.Misc. No.64919 of 2018 (2) dt.25-10-2018 were creating nuisance. Road Jam was also created. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been made accused in this case due to mistake of fact. Altogether 54 persons are named in the FIR alongwith 100-150 unknown persons. No specific overt act has been attributed against the petitioners. General and omnibus allegation has been made against the petitioners. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Rosera, Samastipur in connection with Rosera P.S. Case No. 99 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
