The petitioner is in custody in connection with Chhbilapur P.S.Case No. 51 of 2016 registered under Sections 147, 148, 149, 302 and 120(B) of the Indian Penal Code, pending in the court of learned C.J.M., Nalanda.

The allegation against the petitioner is that he assaulted with iron rod on the head of the deceased.

It has been submitted on behalf of the petitioner that though there is allegation of assault against the petitioner, there is no repetition of blow. It is also submitted that the petitioner has falsely been implicated in this case due to previous enmity and he is in custody for more than four months.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.17734 of 2017 (2) dt.18-04-2017 Having heard both the sides and also considering the allegation against the petitioner of assault causing injury on the head of the deceased, which is corroborated with the Post Mortem Report, I am not inclined to grant bail to the petitioner.
