Petitioner, who is in custody, seeks bail in connection with Jehanabad P.S. Case No. 538 of 2018 registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 35(1-b)(a), 26/35 of the Arms Act.

Allegation against the petitioner and other accused persons is of assembling and planning to commit dacoity with arms and ammunition at the house of Laldeo Yadav. It has been submitted that petitioner is innocent and has been falsely implicated in this case on the basis of suspicion. The name of the petitioner has surfaced on the basis of confessional statement of co-accused Mithilesh Yadav. The

Patna High Court Cr.Misc. No.64980 of 2018(2) dt.05-11-2018 2/2 petitioner was not arrested at the house of Laldeo Yadav. Nothing has been recovered from the possession of the petitioner. Petitioner is in custody since 12.07.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad, in connection with Jehanabad P.S. Case No. 538 of 2018.
