The petitioner apprehends his arrest in connection with Gandhi Maidan P.S. Case No.49 of 2017, registered under Sections 147, 148, 149, 341, 342, 353, 333, 332 and 504 of the Indian Penal Code.

The allegation of the informant is that he being the Enforcement Officer was deputed on 24.1.2017 as Executive Magistrate on declaring the movement of procession from Kargil Chowk to Raj Bhawan through prohibited area by Jan Adhikar Party against the corruption and benami property on the birth day of Jan Nayak Karpuri Thakur. The mob gathered at Kargil Chowk

Patna High Court Cr.Misc. No.18639 of 2017 (2) dt.19-04-2017 2/2 was convinced then mob started to scatter. But at about 1.30 P.M. petitioner being the Member of Parliament along with supporters having lathi, banner, flag, and brick pieces started to move in procession, disobeying police direction throwing brick pieces and raising slogan against administration. Then the petitioner was stopped to move with procession by the police deputed there but they were dashed and the government vehicles were also damaged. Thirteen persons including the petitioner were identified.

Learned counsel for the petitioner submits that petitioner has been implicated in this case with false allegation and is in custody since 27.3.2017.

Having regard to the facts and circumstances of the case and the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-cum-Sub Judge-VI, Patna, in Gandhi Maidan P.S. Case No.49 of 2017.
