1. The defects as pointed out by the office are hereby ignored.

2. Heard learned counsel for the petitioner and learned AC to AAG-4.

3. Learned counsel for the petitioner submits that the land pertaining to Khata No. 96, Plot No. 621 and 623 measuring an area 0.01 decimal and 0.30 decimal respectively at Mauza Kosihan, P.S. Chandi, District Bhojpur is his Khatiyani land while land pertaining to Khata No. 84, Plot No. 621/879, area 0.01 decimal at Mauza Kosihan, P.S. Chandi, District Bhojpur is the purchased land of the father of the petitioner vide registered sale deed dated 13.01.1983.

4. Learned counsel submits that the government fund was

Patna High Court CWJC No.17257 of 2024(2) dt.14-11-2024 2/2 received by the Gram Panchayat for constructing PCC Gali. It is submitted that while constructing the PCC Gali, the land of the petitioner was also utilized forcefully and without his consent. It is next submitted that the authorities without acquiring the land of the petitioner forcefully got the Gali (by- lane) constructed and did not even compensate the petitioner. It is next submitted that petitioner vide his representation dated 12.10.2023 represented before the Collector, Bhojpur at Ara seeking redressal of his grievance but then his representation till date is pending consideration.

5. Learned counsel for the State submits that the case be disposed of with a direction to the Collector to get the matter enquired and dispose of the representation of the petitioner dated 12.10.2023.

6. After hearing the learned counsel for the parties, the writ application is disposed of with a direction to the Collector to get the matter enquired and thereafter to take a decision in accordance with law disposing the representation of the petitioner dated 12.10.2023 within a period of six months from the date of receipt/production of a copy of this order.
