Petitioner seeks bail in Buxar (M) P.S.Case No.228 of 2016 registered under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation against the petitioner is recovery of 47.7 liters of foreign liquor from the house of the petitioner. It has been submitted on behalf of the petitioner that said liquor has been recovered from the joint house of the petitioner and he has not been arrested at the spot. His name was disclosed by the local people. He is accused in one more case also in which he is on bail. He is in custody since18.09.2018. It has been submitted on behalf of the petitioner that no overt act has been committed by the petitioner. There is land dispute between the parties.Allegation of firing is not here.

228/18 subject to the conditions that (I) Bailors must be of local having sufficient immovable properties within the jurisdiction of the court concerned (ii) petitioner/s shall cooperate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his/their bail bond shall be cancelled by the court below and (iii) if the petitioner/s tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner/s (iv) if the petitioner is found involved in similar nature of offence, after his release on bail the trial court shall take steps to cancel his bail bonds.
