JUSTICE SHAILENDRA SINGH ORAL ORDER 14-11-2025 The instant writ petition has been filed by the petitioners under Article 226 of the Constitution of India, seeking the following reliefs :- "(i) For issuance of an application for issuance of an appropriate writ, order or direction or a writ of mandamus directing the Respondents Authorities to exempt the land bearing Khata No. 09, Plot No. 807, 967 and 968 Area 80 dec., 39 dec., 39 dec. (total 1.59 acres) respectively situated at MauzaRamchandrapur, Thana No. 257 Anchal-Pranpur in the District of Katihar which is the purchased land of the petitioners through Registered sale deed before

(ii) Further the Respondent Authorities, Specially Circle Officer, Pranpur, Katihar Respondent No. 4 receipt be directed to the reopen Zamabandi of the land in dispute in the name of the petitioners and enter their names in Register-II of the Block Records and grant rent receipts in their names after receiving rent.

For any other relief (s) for which the petitioners are entitled in the facts and circumstances of the case."

2. Mr. Bhola Prasad, learned counsel for the petitioners and Mr. Gyan Prakash Ojha, learned Government Advocate (GA)-07, are present and they are heard.

The main grievance which has been raised by the petitioners relates to the provisions of section 15(1) of the Ceiling Act and for redressing the same, on 24.01.2025 the petitioners have filed an application before the Collector, Katihar (respondent No. 2), by way of Annexure-'P5', which is running for taking decision on the part of the Collector, Katihar, who is sitting tight on that application.

4. Learned Government Advocate (GA)-07 for the State-respondents submits that the Collector, Katihar (respondent No. 2), may be directed to dispose of the petitioners' application at the earliest.

Considering the aforesaid submissions and taking into account the averments made in this writ petition, this Court is of the view that the issue raised by the petitioners in this writ petition is premature for consideration by this Court under its writ jurisdiction, however, the Collector, Katihar (respondent No. 2), is directed to dispose of the petitioners' application dated 24.01.2025 (Annexure-'P5') as per the provisions of law, according to merit, within two months from the date of receipt of this Court's order or production of the same.

6. With the above direction, the instant writ petition stands disposed of.
