The petitioners, who are in custody, seek bail in connection with Buxar Mahila P.S. Case No. 75 of 2018 registered for the offence punishable under Sections 341, 323, 504, 506, 376 & 34 of the Indian Penal Code and POCSO Act, 2012 U/s 06 corresponding to POCSO Case No. 54/18. Informant has alleged that on 17.09.2018 at 7.00 PM when she had gone alone to worship then Chandan Sah forcibly took her on motorcycle and committed rape upon her after taking her in a isolated place and thereafter dropped her at her residence and thereafter all family members went to the

Patna High Court Cr.Misc. No.67913 of 2018(2) dt.06-11-2018 2/2 house of Chandan Sah and informed them of the criminal act committed by Chandan Sah then petitioners who are mother and sister of Chandan Sah threatened that if she institute any case they will also institute case against her and also abused them and got Chandan Sah fled from the house.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-1 cum Special Judge SC/ST & POCSO Act, Buxar, in connection with Buxar Mahila P.S. Case No. 75 of 2018 subject to the conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.

3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
