The petitioners are languishing in custody since 06.07.2019 in a case registered for the offences punishable under Sections 346, 366A, 367, 370, 370A, 372, 373, 376, 120B of the Indian Penal Code, Sections 3, 5, 6, 7 and 8 of the Immoral Traffic (Prevention) Act, 1956 and Sections 4, 6, 12, 17 of the Protection of Children from Sexual Offences Act, 2012 and Sections 75 and 81 of the Juvenile Justice (Care and Protection of Children) Act, 2015.
On the basis of written complaint of one Sanju Singh
Patna High Court CR. MISC. No.69347 of 2019(2) dt.27-11-2019 2/3 to the effect that immoral Traffic is going on at several places, raid was laid at several places and during course of raid, from the house of the petitioners, two minor girls were recovered along with other incriminating articles.
It is submitted by learned counsel for the petitioners that the said recovery has been made from the joint family house and the investigation has already been concluded. Moreover, similarly situated co-accused have been granted bail by different Co-ordinate Benches of this Court vide order dated 19.1.2019, 13.11.2019, 04.11.2019, passed in Criminal Miscellaneous Nos. 69991, 65747, 65264 of 2019 respectively. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent. Learned APP for the State submits that the accusation is specific against the petitioners. Considering the investigation being already concluded, coupled with statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st ADJ-cum-Special Judge, West Champaran at
