JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-11-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Bochahan P.S. Case No. 389 of 2023 registered for the offences punishable under Sections-341, 342, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.
Allegedly, the petitioner along with other accused persons, reached at the land of informant with a view to grab the same and on objection being raised by the informant, the accused persons are said to have assaulted the informant causing bleeding head injury to him.
Learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. He has falsely
Patna High Court CR. MISC. No.71840 of 2023(2) dt.08-11-2023 2/2 been implicated in the present case. There is allegation on him to inflict Farsa blow on the neck of informant, which hit on his head. There is land dispute between the parties. As per medical report, only physical assault was found out on the person of the informant and the injury is said to be simple in nature. Learned Additional Public Prosecutor opposed the prayer for bail.
Considering the above-mentioned facts and circumstances, specially clean antecedent of the petitioner, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Court No. 4 of Judicial Magistrate-Ist Class, Muzaffarpur (East), Muzaffarpur in connection with Bochahan P.S. Case No. 389 of 2023, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) A.K.V.//- U T
