Mr. Ranganath Choubey ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 16-04-2024 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.

2. The petitioners apprehend their arrest in Dinara P.S. Case No. 281 of 2023 registered for the offences punishable under Sections 293, 294, 500, 506, 509, 354(C) and 34 of the Indian Penal Code and Section 66(E), 67(B) of the I.T. Act.

3. It is alleged by the informant that the petitioners used to send her vulgar and obscene photographs through social media and harassing her regularly. It is further alleged that petitioners has regularly threatened her.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in

Patna High Court CR. MISC. No.71500 of 2023(5) dt.16-04-2024 2/2 this case. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. He submits that there is specific overt act against petitioner no. 1, but petitioner no. 2 is falsely implicated only because he is maternal uncle of petitioner no. 1. The petitioners have no criminal antecedent as mentioned in para-3 of this application.

5. Learned APP for the State as well as learned counsel for the informant submitted that the petitioner is also involved in the present case. Learned counsel for the informant has filed a detailed counter affidavit enclosing therein the obscene photographs.

6. Considering the facts and circumstances of case and the nature of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected.
