The petitioner seeks pre-arrest bail in connection with Sadar P.S. Case No. 500 of 2019 registered under Sections 420, 406, 506, 504 and 34 of the Indian Penal Code. The accusation is that informant and several other persons used to deposit money through Amritesh Kumar and Santosh Kumar in the scheme in Thrift Credit Self Supporting Cooperative Society Ltd., Bhawati, Hajipur Circle, Vaishali at Hajipur, having its head office in front of Central Bank of India, Muzaffarpur. After maturity, when informant and others made demand of matured amount, then, Amritesh Kumar and Santosh Kumar disclosed that Jawahar Lal Sah is the Chief Executive Officer whereas Anil Kumar Choudhary (petitioner) is the Zonal Manager and Mukesh Kumar is the Regional Manager of the Society and it is the apprehension that they have misappropriated the amount of the informant and others.

Patna High Court CR. MISC. No.64188 of 2019(2) dt.22-10-2019 2/2 Submission is that in fact Kamta Choudhary and Gaya Choudhary, father and uncle of the petitioner, leased out his land in favour of co-accused, Jawahar Lal Sah, Chief Executive Officer of the said Society and due to that reason the petitioner has also been implicated in this case mere on suspicion. It has also been submitted that the petitioner has no concern with the Society, as detailed in the first information report, nor even he received money from the informant and others. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Sadar P.S. Case No. 500 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
